Terms and conditions governing the booking and delivery of osteopathic treatments at Osteopathie Seebach GmbH, Birchstrasse 650, 8052 Zürich. Every booking implies acceptance of these terms.
Subject of the terms
These terms and conditions apply to all services provided by Osteopathie Seebach GmbH, whether the service is delivered at the practice, remotely (phone, email) or booked online through OneDoc. They supplement the information given on the patient registration form and the privacy policy. Individual written agreements prevail over these terms. Should any provision be found invalid or unenforceable, the validity of the remaining provisions is unaffected.
Healthcare services
The practice offers osteopathic consultations and treatments provided by Mia Macdonald. Osteopathy is a complementary medicine approach: it does not replace a medical diagnosis, medical treatment or emergency care. In the event of acute symptoms or warning signs, the therapist will refer the patient to a physician or to emergency services. The treatment approach is explained and discussed with the patient before each session.
Booking and cancellation
Appointments can be booked online through OneDoc, by phone or by email. Patients are kindly asked to cancel or reschedule their appointment at least 24 hours in advance; failing this, the session may be charged in accordance with tariff code 1250 (missed consultation) of the rate list published on the website. As a courtesy, a cancellation due to illness is in principle charged at 50 % of the session fee, and no charge is made if the slot is taken over by another patient. Patients are kindly asked to arrive on time so that their session is not shortened.
Fees and payment
Billing is based on the industry tariff 590, per commenced time unit, in accordance with the rate list published on the pricing page of the website. Payment terms (accepted methods and due date) are communicated at the practice. Osteopathy is not a compulsory benefit of the basic insurance scheme; reimbursement may be available depending on the terms of the patient's supplementary insurance. A receipt is provided to the patient for the reimbursement claim.
Liability and patient duties
Treatments are carried out with the professional care required by the profession (obligation of means). Because the outcome of a treatment depends on many patient-specific factors, the practice cannot guarantee any particular therapeutic result. The patient undertakes to provide accurate and complete information about their state of health, medical history, medication and any contraindications (in particular pregnancy). In accordance with Article 100 of the Swiss Code of Obligations, the practice may not exclude in advance its liability in the event of gross or intentional negligence, nor for personal injury. The practice accepts no liability for personal belongings left on the premises.
Confidentiality and data protection
The practice is bound by professional confidentiality. Patients' personal and health data are processed confidentially in accordance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the General Data Protection Regulation (GDPR) of the European Union. Data is disclosed to third parties only in the cases provided for by law or with the patient's consent, in particular for invoicing and reimbursement by insurers. For further details, patients are referred to the practice's privacy policy.
Applicable law and jurisdiction
These terms and conditions are governed by Swiss law. The place of jurisdiction is the registered office of the practice in Zürich, subject to mandatory statutory provisions in favour of the patient, in particular consumer protection.
Amendments
The practice may amend these terms and conditions at any time. The version published on the website is binding.
Language of the terms
The French, German and English versions of these terms are equally binding. In the event of divergence between the versions, the German version prevails.
Miscellaneous
The practice does not treat children under 12 years of age; relevant information is provided on the services page. For any question or complaint regarding these terms, the patient may contact the practice by email (osteopathieseebach@osteo-hin.ch) or by phone (+41 44 517 8052).
